Heterogeneous- different people, cultures, etc.
Immigrant- Legal aliens that move to a different country.
Reservation- public land given to the Native Americans by the government.
Refugee- they live here for protection purposes
Assimilation- adapting to another culture.

April 02, 2014

The population of the US is prominently white- today and has been historically as well.
Minority populations exceed white populations in the following states: California, Hawaii, New Mexico, and Texas.
More females than males

African Americans
African Americans have been the victims of consistent and deliberate unjust treatment for a longer time than any other minority group in the US
Most of the gains the nation has come from the African Americans

Native Americans
*Nearly a million Native Americans were alive in the 1600s
*By 1900 that number was 250000. It is 6 million today.
*American settlers brought diseases that hurt the Indian population.
*Poverty, joblessness, and alcoholism plague many reservations today.

Hispanic Americans
* have a Spanish speaking background
*can be any race
*divided into four main subgroups: Mexican Americans, Puerto Ricans, Cuban americans and central and south Americans.

Asian Americans
*Chinese laborers were the first Asians to come to America in large numbers in the 1850s and the 1860s- often faced violence because white workers were unhappy
*Chinese Exclusion Act of 1882- 80 yrs
* all Japanese were evacuated to the pacific coast. Even native born.
* Congress eventually decided that this was wrong

04/07/2014
*Those who oppose Civil Rights often believe you can't change morality by passing a law: people wont think treat others differently just because the Federal Government says they should
*Dr. King: "Judicial decrees...may not change the heart, but they can restrain the heartless."
*1870's-1950's: no meaningful legislation passed in regard to civil rights
*The Civil Rights Acts of 1964: passed after the longest debate in Senate history(83 days). Made changes in the following:
1.) voting provisions
2.) public services could no longer deny access based of race, religion, national origin, physical disability, etc.
3.) Federal funding programs could not discriminate for those reasons.
4.) Employers and labor unions could not discriminate for those reasons
* Civil Rights act of 1968: aka- "Open Housing Act"- cannot refuse selling/rent living space to a person due to race, religion, national origin, physical disability, etc.
*Title IX: forbids discrimination on the basis of gender in any educational program or program regarding financial assistance. Equal funding and opportunities must be given to women athletics
Affirmative Action
* Requires employers take positive steps to fox the affects of past discrimination
* Employers must meet quotas for minority groups/genders
*Many argue this results in reverse discrimination: discrimination against the majority group:
* "Color Blind"
* California, Washington Michigan, and Nebraska voters passed measures to eliminate all affirmative action plans.
*The Bakke Case
* Allan Bakke sued the University of California because he was denied access to their medical school due to Affirmative Acton. ( 16/100 sears were reserved for minority students.)
*Bakke won the case
*Since then. the Court has made decisions regarding similar cases: quotas can be used when needed
* Justice Sandra day O'Connor predicts in 25 years. the use of racial preferences will no longer be neccesary.

April 08,2014
An american citizen is a person that swars allegiance to the us and is entitled to its protection and privileges of its laws.
* 14th amendment-All persons born or naturalized in the us and subject to the jurisdiction thereof, are citizens of the united states and  of the state wherein they reside
* the constitution declares that a person becomes an american citizen one of two ways: by birth or naturalization.
*Citizenship by birth
90% of Americans are citizens by birth.

*Citizenship by naturalization
*Naturalization: legal process by which a person can become a citizen of another country at some time after birth.
*Normally, naturalization is done individually
*Collective naturalization: entire groups can be granted citizenship through en masse. This normally happens ehn the us gains a new territory- naturalized by an act or treaty.

Loss of Citizenship
*Every american citizen has the right to voluntarially abandon his/her citizenship through
*Denaturalization: when a naturalized citizen loses their citizenship.
*Marriage: does not make a person a "citizen" -only shortens the time of the naturalization process

Immigration
* Congress has exclusive power to regulate the crossing of this nation's borders: inward and outward
* Immigration Act of 1965: did away with the quota system
* Immigration Act of 1990: governs the admission of aliens into the US. This act now allows 675,000 people every year.
* Some people are denied entrance based of their characteristeics: criminals, mentally ill who might be a harm, etc.
* Deportation: legal process ny which aliens are required to leave the country.
*Biggest reasons for deportation: illegal immigrant, conviction of a serious crime.

Supreme court cases

1.)2012: On June 28, 2012, the Supreme Court issued a complicated ruling in National Federation Of Independent  Business et al. V. Sebelius, Secretary of Health And Human Services, et al. that upheld the constitutionality of the Affordable Care Act (ACA), the health care reform law passed by Congress and signed by President Obama in 2010. While the decision ultimately supported health care reform, it also created some new problems for ACA implementation and signaled a continued threat to the Constitution’s role as a protector of civil rights. Inferior Courts
US district courts are the federal trial courts- 677 judges handle more than 350000 cases per year 80% of the federal caseload.

FISA- meet in secret and are entitles to secret search warrants.

district court juristiction
* do not deal with cases within original juristiction of the supreme court
*Hear both criminal and civil cases
*Most decisions in the federal district courts are final- meaning the cases start and end there.
*A few cases go to higher courts if the losing party appeals the hearing

Courts of appeals
* created by congress to relieve the Supreme court of hearing all appealed cases
* Each court has 6- 28 judges and 1 supreme court justice is assigned to each district

Court of international trade
*only tries civil cases that arise out of the nation's customs and other trade related laws
*9 judges- chief justice appointed by the president and senate

BR 03/20/2014

Judicial restraint- believe that judges should decide cases on the basis of (1) original intent of the Framers or those who enacted the statue(s) involved in a case, and (2) precedent- a judicial decision that serves as a guide for settling later cases of a similar nature.
